Beau Jackson, of Shepparton, successfully applied for bail at Shepparton Magistrates’ Court.
He is charged with assault, possessing a controlled weapon and possessing methamphetamines.
A police officer told the court police alleged Mr Jackson punched a man in the head, knocking him to the ground, before he kicked his mouth and hit him with a bluetooth speaker at a Shepparton house on December 8, 2024.
The man lost two of his bottom teeth after Mr Jackson allegedly kicked him in the mouth before threatening to hit him with a hammer, the court heard.
Mr Jackson was on two counts of bail when police arrested him for the offence.
The police officer said Mr Jackson was “aggressive, violent and unpredictable” and shouldn’t be granted bail.
Mr Jackson’s defence solicitor Shana McDonald noted the police’s delay in arresting her client, as the offence happened more than five weeks ago.
Ms McDonald told the court her client had significant health issues and was open about his drug addiction and wanting to get clean.
She said Mr Jackson was self-motivated to get into rehabilitation, and there were drug and alcohol support systems available to him in the community.
Ms McDonald said her client was “surrounded by drugs” at his Shepparton house, but he was going to stay with his uncle in Wallan, and there was a possible bed at a residential rehabilitation facility.
In granting Mr Jackson bail, Magistrate Olivia Trumble said it was “a bit rich” of the police to allege he was an unacceptable risk to the community when his offending was in December, and he hadn’t been missing.
Among Mr Jackson’s bail conditions were that he live in Wallan, report to police twice a week, comply with a 10pm to 6am curfew, not leave Victoria or Australia, and engage with the Victorian Aboriginal Health Service.
Mr Jackson has not entered any pleas yet and will next appear at Shepparton Magistrates’ Court in March.
