James Dailey, 39, of Kialla, pleaded guilty in Shepparton Magistrates’ Court to refusing to accompany police for a breath test, driving unlicensed and driving an unregistered vehicle.
Prosecutor Leading Senior Constable Brent O’Grady told the court Dailey twice refused to accompany police to the police station to be breath tested after a preliminary breath test indicated there was alcohol present in his breath.
It came as Dailey was pulled over by police in Lachlan Cres in Shepparton on March 17 last year.
His Holden Commodore sedan was also unregistered and impounded for 30 days at a cost of $1240.
Dailey was also unlicensed.
The court heard Dailey told police at the time he had “had half a dozen cans” and was going to refuse the breath test.
Dailey’s solicitor Anthony Coote argued that his client was now engaging with other government agencies, which included him doing drug screens.
In fining Dailey $2000 and disqualifying him from driving for four months, magistrate Peter Mithen warned the only thing that stopped him from going to jail was his engagement with the other government agency and work it was making him do.
“Quite frankly, your driving history is appalling,” Mr Mithen said.
“It demonstrates you have no respect at all for yourself, anyone who drives with you, or other road users.”
