Cr Weyrich had been convicted and fined $1000 after pleading guilty to a charge of assault occasioning bodily harm at Moama Local Court in November 2022.
That court heard Cr Weyrich repeatedly struck a man at a Moama car wash in August 2022.
Cr Weyrich appealed the severity of the sentence with the matter heard in Albury District Court.
Judge Grant upheld the appeal and set aside the orders of the local court.
“Thomas Emil Weyrich is found guilty, but without proceeding to a conviction, is sentenced to a Conditional Release Order for a period of 12 months to commence on February 15, 2023 and expiring on February 14, 2024,” Judge Grant said.
The decision means no conviction is recorded and Cr Weyrich will also not have to pay the fine.
Under the terms imposed by Judge Grant, Cr Weyrich is to not commit any offence while subject to the Conditional Release Order and must appear before the court if called upon to do so at any time during the term of the Conditional Release Order.
“I’m pleased to have won my appeal (today) and have the conviction quashed,” Cr Weyrich said.
“The whole episode was regrettable.
“This decision means a whole lot to me.”
Cr Weyrich said he could now focus on his role as councillor for the Greater Murray Ward.
“I’ve served as a councillor for nearly 25 years,” he said.
“I can now move on from this and continue to represent the people who live in the Murray River Council.”
